Terms of Service

You must be at least 13 years old to create an account, and at least the age of majority in your province (18 in Ontario) to make a purchase, or have the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity under your account.

All orders placed through the Service are for in-store pickup only at our Orléans location. We do not deliver. When you place an order you select a pickup time; that time is an estimate based on our current preparation times and is not guaranteed.

Pickup hours are Monday–Friday 7:30 AM – 9:00 PM and Saturday–Sunday 7:30 AM – 7:00 PM. Hours may change on holidays or without notice.

Orders not collected by closing on the pickup day may be discarded for food-safety reasons and are not automatically refunded. (Catering: see our Refunds policy — uncollected catering is refunded on request.) Please contact us as soon as possible if you cannot collect an order.

We may refuse, limit, or cancel any order — including after it has been submitted — for reasons such as product unavailability, suspected fraud, errors in pricing or description, abusive behaviour, or circumstances beyond our control. If we cancel a paid order, we refund it as described in our Refunds & Cancellations Policy.

Catering orders require a minimum of 6 hours of preparation time and are sold by the dozen in 30-minute pickup windows. Catering must be paid in full at the time of booking. Catering pickup hours are Monday–Friday 11:00 AM – 8:30 PM and Saturday–Sunday 11:00 AM – 6:30 PM. Large or custom requests may require additional lead time; we will contact you if we cannot fulfil a booking.

Prices are shown in Canadian dollars and exclude applicable taxes, which are added at checkout (HST in Ontario). Prices, items and availability may change at any time. If an item's price is displayed incorrectly, we reserve the right to cancel the affected order and refund you in full.

Card payments are processed by Stripe. We do not receive or store your full card number, CVC, or expiry date; those details are handled directly by Stripe under its own terms and privacy policy. By paying you authorize us to charge the total shown, including taxes and any additional charge you approve.

Additional charges: if you request extras after placing an order (for example added items or modifications), our staff may add an additional charge to your order. You will be notified in the app and asked to pay any outstanding balance before pickup. You are not charged extras without a new, explicit payment step.

Made in a shared kitchen with wheat, milk, eggs, sesame, tree nuts, peanuts, soy, mustard and sulphites. We can't guarantee any item is allergen-free. Please read our Allergens & Food Safety notice carefully before ordering. Item descriptions, dietary labels (such as “vegetarian” or “vegan”) and nutritional impressions are provided for general guidance only and may change without notice.

You may submit order notes and special requests. Do not submit unlawful, abusive, deceptive, or infringing content, attempt to interfere with the Service, access other users' data, reverse engineer the app, use automated tools to scrape or place orders, or use the Service for any unlawful purpose. You grant us a limited licence to use the information you submit solely to fulfil your order and operate the Service.

The Service, including its name, logo, text, images, and software, is owned by Ali Baba Bakery Inc. or its licensors and is protected by Canadian and international law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. All other rights are reserved.

The Service uses third parties to operate, including Stripe (payments), our cloud hosting and database provider, Apple and Google (app distribution, sign-in and push notifications), and mapping apps you may open for directions. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

Except where the law does not allow it, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that pickup estimates, notifications or availability information will always be accurate.

Nothing in these Terms limits any non-excludable consumer rights you may have, including under Ontario's Consumer Protection Act, 2002 and the Sale of Goods Act.

To the maximum extent permitted by law, Ali Baba Bakery Inc. and its directors, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service or an order is limited to the greater of (a) the amount you paid for the order giving rise to the claim, and (b) CAD $100.

This limitation does not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.

You agree to indemnify and hold harmless Ali Baba Bakery Inc. from claims, damages and reasonable expenses arising out of your misuse of the Service or your breach of these Terms or of applicable law.

You may delete your account at any time from Account → Settings → Delete my account. We may suspend or close an account that breaches these Terms. Certain transaction records are retained after deletion where we are legally required to keep them (see the Privacy Policy).

We may update these Terms from time to time. The “Last updated” date above shows when. Material changes will be highlighted in the app where practical. Continuing to use the Service after a change means you accept the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts of Ontario, subject to any right you have to bring a claim before a small claims court or a consumer tribunal where you live. We encourage you to contact us first — most issues are resolved with a phone call.

If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and Ali Baba Bakery Inc. only, not Apple, and that Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance, or intellectual-property claims, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. Similar terms apply to Google in respect of Google Play.
